Terms of Service

1. Acceptance & Eligibility

• You must be at least 13 years old (16 in EU/UK) to use Konvexa.
• By using the Service, you represent that you have the legal capacity to enter into this Agreement.
• If using on behalf of an organization, you warrant you have authority to bind them.

2. Description of Service

Konvexa provides free, browser-based tools including but not limited to:

• File format conversion (images, audio, video, PDFs, archives, documents)
• Media downloading from YouTube, Spotify, TikTok, Instagram (public content only)
• Developer utilities (checksums, metadata viewer, subtitle translation, favicon generation)
• Client-side processing via WebAssembly (FFmpeg, libarchive, JSZip, etc.)
• Server-side conversions via CloudConvert and direct API integrations

The Service is provided "as is" and "as available". We reserve the right to modify, suspend, or discontinue any tool without notice.

3. User Accounts & Authentication

• Authentication is handled by Clerk. We do not store passwords.
• Accounts are free. Premium features (history, exclusive tools) require sign-in.
• You are responsible for securing your authentication method (email, Google, GitHub).
• We may ban IPs or accounts for abuse, spam, or Terms violations.
• Account deletion is via Clerk dashboard or by contacting support.

4. Acceptable Use

You agree NOT to:

• Upload illegal, harmful, copyrighted (without rights), or malicious content.
• Use tools for copyright infringement, piracy, or DRM circumvention.
• Download private/paid content from YouTube, Spotify, TikTok, Instagram.
• Automate, scrape, or bulk-download via scripts/bots (API not public).
• Overload the Service (rate limits exist: ~5 conversions/min, 100 req/min).
• Reverse-engineer, decompile, or attempt to extract source code.
• Transmit malware, viruses, or exploit payloads via file uploads.
• Impersonate others or misuse the feedback/contact system.

Violations may result in immediate IP ban, account termination, and legal action.

5. Intellectual Property

• Our IP: Konvexa's code, UI, branding, tools, and documentation are owned by us. Licensed for personal use only.
• Your Files: You retain all rights to files you upload. We claim no ownership.
• Third-Party Content: YouTube, Spotify, TikTok, Instagram content belongs to respective creators/platforms. Downloading is for personal, non-commercial use only per their Terms.
• Open Source: Konvexa uses open-source libraries (FFmpeg, libarchive, etc.). Their licenses apply.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability, fitness for a particular purpose, non-infringement.
• Uninterrupted, timely, secure, or error-free operation.
• Accuracy, reliability, or completeness of conversions/downloads.
• Compatibility with all file formats, browsers, or devices.
• Availability of third-party sources (YouTube, Spotify, etc. may change APIs without notice).

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Konvexa and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Total liability shall not exceed $0 (the Service is free).
• We are not liable for: data loss, corrupted files, failed conversions, downtime, third-party API changes, or misuse of downloaded content.
• You assume all risk for files you upload and content you download.

7. Indemnification

You agree to indemnify and hold harmless Konvexa, its operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

8. Third-Party Services & APIs

Konvexa integrates with third-party services. Your use is also subject to their terms:

• Clerk Terms (Authentication)
• Vercel Terms (Hosting/Analytics)
• CloudConvert Terms (Conversions)
• RapidAPI Terms (YouTube links)
• YouTube Terms
• Spotify Terms
• TikTok Terms
• Instagram Terms

9. DMCA / Copyright

We respect intellectual property. Konvexa does not host user content permanently. If you believe your copyrighted work has been downloaded via our tools in violation of your rights, note that:

• We only facilitate access to publicly available URLs.
• We do not store or index copyrighted works.
• To request removal of a download link, contact dmca@certiswift.in with: (a) identification of the work, (b) the infringing URL, (c) your contact info, (d) good-faith statement.
• We will process valid notices within 48 hours.

10. Termination

We may terminate or suspend your access immediately, without prior notice, for breach of these Terms. Upon termination, your right to use the Service ceases. Provisions that should survive (IP, Liability, Indemnification) will survive.

11. Governing Law & Disputes

These Terms are governed by the laws of India (where CertiSwift Technologies operates), without regard to conflict of law principles. Disputes will be resolved in courts of competent jurisdiction in Bangalore, Karnataka. If any provision is unenforceable, the rest remain in effect.

12. Changes

We may update these Terms at any time. Material changes will be posted on the Updates page and announced via in-app notification. Continued use after changes constitutes acceptance. Check this page periodically.
